1. Acceptance of Terms

These General Terms and Conditions constitute a legally binding agreement between you — acting either on your own behalf or as a representative of a legal entity — and Total Buy s.r.l. (Calea Dorobanților 23, 400117 Cluj-Napoca) (hereinafter referred to as "the Company"), governing your access to and use of the vapentino website, as well as any associated media formats, channels, mobile websites, or applications linked to it.

By accessing or using the website, you confirm that you have fully read, understood, and accepted these Terms and Conditions and agree to be legally bound by them. 

You acknowledge that the products and information made available on this website are not intended for distribution or use in any jurisdiction where doing so would be contrary to applicable law or regulation, or where prior registration would be required. Any individual who accesses the website from such a jurisdiction does so at their own risk and is solely responsible for compliance with local laws.

Access to and registration on this website is strictly prohibited for persons under the age of 18. The electronic cigarette products offered by the Company are not suitable for use by minors, pregnant women, individuals with known allergies to propylene glycol (PG), or those diagnosed with cardiovascular disease or diabetes.

Certain products — particularly those containing nicotine — may be subject to legal restrictions in specific countries. It is your responsibility to familiarise yourself with and comply with the relevant regulations in your country of residence or the country to which delivery is requested. In some jurisdictions, the purchase (including online ordering), possession, use, or distribution of such products may be strictly prohibited.

The Company endeavours to display and maintain up-to-date information regarding the essential characteristics of all products available for purchase in the webshop. However, manufacturers may occasionally alter labelling, packaging, or the physical appearance of their products without prior notice, as formulations and designs are subject to ongoing development.

As the Company does not always receive advance notification of such changes, all product descriptions, composition data, and images provided on the website are for informational purposes only and cannot be fully guaranteed for accuracy. The Company will make reasonable efforts to reflect any changes promptly; however, the information provided should be regarded as indicative only. Product images are sometimes used for illustrative purposes, and colour discrepancies between the actual product and its digital representation may occur due to variations in display settings across different devices.

4. Purchasing and Payment

By placing an order through the website, you agree to provide accurate, complete, and current billing and delivery information. Where required by applicable regulations, sales tax or other duties may be applied to your purchase. The Company reserves the right to modify prices at any time without prior notice.

You agree to pay all applicable charges, including any shipping fees, at the prices in effect at the time your order is placed. By completing a purchase, you authorise the Company to charge your chosen payment method for the total amount due. The Company further reserves the right to correct any pricing errors or inaccuracies, even after payment has been requested or received.

The following payment methods are accepted:

•       Cash on delivery — payment upon receipt of goods. Please note that an additional surcharge may apply depending on the destination country. The applicable fee will be displayed at checkout.

•       Online payment via the Stripe payment platform. Accepted payment methods include: MasterCard, Visa, Maestro, Apple Pay, Google Pay, UnionPay, and JCB.

The Company reserves the right to refuse any order placed through the website at its sole discretion. Additionally, the Company may limit or restrict the quantity of products that may be purchased per individual, per household, or per order, including orders associated with the same customer account, payment method, or billing and shipping address.

5. Shipping

Please ensure that all shipping details provided — including your delivery address, telephone number, and email address — are accurate and complete prior to submitting your order.

The Company accepts no liability for failed deliveries or lost parcels resulting from an incorrect or incomplete shipping address provided by the customer. In cases where a parcel cannot be delivered and is returned to the Company due to an address error, a refund will be issued for the cost of the products only; original shipping fees will not be refunded. Should the customer wish to have the order re-dispatched to an alternative address, the associated shipping costs will be borne by the customer.

If you instruct the courier to leave the parcel unattended at your door or any other unsecured location, the Company cannot be held responsible for any resulting loss or non-delivery. We strongly recommend arranging for personal receipt of your delivery or requesting that the parcel be held at a designated collection point or DEPO location.

In the event that your parcel arrives visibly damaged, please refuse to accept the delivery and request that the courier formally document the damage. This enables the Company to pursue a claim against the courier for the value of the affected goods, and a full refund will be issued to you accordingly.

6. Warranty and Return Policy

Customers are advised to inspect all disposable products upon receipt to verify their condition and functionality.

All products sold through the webshop are covered by warranty in accordance with applicable statutory requirements and the commercial practices of the relevant manufacturers. Products are supplied in their original packaging, sourced exclusively from verified and authorised suppliers.

Claims relating to defective products must be submitted within 48 hours of receipt of the goods. Given that disposable products are designed for single use and cannot be repaired or subjected to post-delivery testing, warranty claims for such items are subject to the same 48-hour deadline. To substantiate a warranty claim, customers may be asked to provide a video recording demonstrating the reported defect. Upon confirmation of the defect, the customer will be entitled to select a replacement product from available stock.

The warranty described above applies solely to the product itself and does not extend to any damage caused by the product to other objects or property. Defective products will be replaced as promptly as possible. In the event that the original product is no longer available, the customer may select replacement items of equivalent value.

If you wish to return your order or individual items, you may do so within 14 days of the date of purchase. Return shipping costs are the responsibility of the customer. For hygiene reasons, only products that remain unopened and in their original packaging are eligible for return.

7. Modifications and Termination

TotalDistribution s.r.l. reserves the right, at its sole discretion and without prior notice, to modify, suspend, remove, or discontinue any content, features, or services available through the website. The Company is under no obligation to update or maintain the accuracy of information published on the website and accepts no liability for any modifications, price changes, service suspensions, or discontinuation of the website or any part thereof.
